1. Acceptance of Terms
By accessing or using the Service provided by ResumeBuilder Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service, including free and paid users.
2. Description of Service
The Service is an online platform that allows users to create, edit, and download professional resumes as PDF files, and to generate accompanying web portfolio pages. The Service includes a visual resume builder, template library, AI writing assistance (for Pro users), portfolio hosting, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.
3. Account Registration
3.1 Requirements
To use certain features of the Service, you must create an account. You must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.2 Accuracy of Information
You agree to provide accurate, current, and complete information during registration and to keep it updated. Providing false or misleading information may result in suspension or termination of your account.
3.3 Account Limits
Free accounts are limited to 3 saved resumes and 10 AI suggestions per resume. Pro accounts have unlimited resumes and AI suggestions. We reserve the right to implement rate limits and fair use policies to prevent abuse.
4. User Content
4.1 Ownership
You retain all rights to the content you create using the Service, including resume text, portfolio content, and any other materials you upload or input ("User Content"). We do not claim ownership over your User Content. You grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service (e.g., generating your PDF and portfolio page).
4.2 Your Responsibility
You are solely responsible for the accuracy, legality, and appropriateness of your User Content. You represent and warrant that your User Content does not violate any applicable law, regulation, or third-party right, including intellectual property rights, privacy rights, or employment laws.
4.3 AI-Generated Content
Content generated by our AI features is provided for your convenience and should be reviewed carefully before use. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated suggestions. You are responsible for ensuring that AI-generated content in your resume is truthful and does not misrepresent your qualifications. We are not liable for any consequences arising from your use of AI-generated content.
5. Intellectual Property
5.1 Our Intellectual Property
The Service, including its design, templates, source code, graphics, logos, icons, text, and overall appearance (excluding your User Content), is owned by or licensed to ResumeBuilder Inc. and is protected by copyright, trademark, and other intellectual property laws. Our templates are designed by our team and may not be copied, modified, or redistributed outside of the Service.
5.2 Trademarks
"ResumeBuilder," our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ResumeBuilder Inc. You may not use these marks without our prior written permission.
5.3 Restrictions
You may not: copy, modify, or distribute any part of the Service's code or design; extract or scrape our template library, content, or data; use our trademarks or branding in any way that suggests endorsement; reverse engineer any aspect of the Service; or use automated tools to access the Service in a manner that exceeds reasonable use.
6. Prohibited Uses
You agree not to use the Service to: create resumes or portfolios containing false, misleading, or fraudulent information; impersonate any person or entity; violate any applicable local, state, national, or international law; distribute spam, malware, or other harmful content; attempt to gain unauthorized access to our systems or other users' accounts; interfere with or disrupt the integrity or performance of the Service; use the Service for any purpose that is unlawful or that could harm ResumeBuilder, its users, or third parties; create accounts using automated means or in bulk without authorization.
7. Payment Terms
7.1 Pricing
Pro subscription pricing is displayed on our pricing page and may be changed at any time with 30 days' notice. Price changes will not affect your current billing period — you will be notified of the new price before your next renewal.
7.2 Billing
Paid subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Payment is processed through Stripe. By providing your payment information, you authorize us to charge the applicable fees to your payment method.
7.3 Refund Policy
We offer a 14-day money-back guarantee on all new Pro subscriptions. If you are not satisfied within the first 14 days, contact us for a full refund. After 14 days, refunds are issued at our sole discretion. No partial refunds are available for unused portions of an annual plan after the 14-day window.
7.4 Cancellation
You may cancel your subscription at any time from your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until that date. After cancellation, your account reverts to the Free plan — your resumes and data are preserved, but Pro features become unavailable.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (A) THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. (B) IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. (C) OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER. THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED.
9. Indemnification
You agree to indemnify, defend, and hold harmless ResumeBuilder Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your User Content; your violation of these Terms; or your violation of any rights of a third party.
10. Termination
10.1 By You
You may delete your account at any time from your account settings. Upon deletion, we will remove your personal information in accordance with our Privacy Policy. Resume data associated with your account will be permanently deleted within 30 days.
10.2 By Us
We may suspend or terminate your access to the Service at any time for violation of these Terms, fraudulent or abusive behavior, or any other reason at our sole discretion. We will provide reasonable notice where possible, except in cases involving serious violations, security threats, or legal requirements.
10.3 Effect of Termination
Upon termination: your right to use the Service ceases immediately; provisions that by their nature should survive (intellectual property, limitation of liability, indemnification, governing law) will remain in effect; and we are not liable for any loss or damage resulting from the discontinuation of the Service.
11. Disclaimer: Not Legal or Career Advice
The Service provides tools for creating resumes and portfolios. We do not provide legal, career, employment, or professional advice. The content of your resume is your responsibility. We do not guarantee that using our Service will result in employment, interviews, or any particular outcome. ATS compatibility claims are based on our testing and are not a guarantee that any particular employer's ATS system will parse your resume without issues.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class-action lawsuits. This arbitration clause does not prevent you from seeking injunctive relief in court for intellectual property infringement or unauthorized access to your account.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Non-material changes may take effect immediately upon posting. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
